General terms and conditions of sale and delivery

*ART. 1 Offers/agreements*
SGM Consultancy reserves the right to change prices, in particular when required by (legal) regulations.
*ART. 2 Orders/communications*
SGM Consultancy is not liable for misunderstandings, mutilation, delays or improper transmission of orders and notifications as a result of the use of the Internet or any other means of communication in its traffic with SGM Consultancy, unless and insofar as there has been intent or gross negligence on the part of SGM Consultancy.
*ART. 3 Delivery costs*
For customers from the Netherlands, Belgium and Germany, we ask a contribution of €7.50 for shipping costs per order.
*ART. 4 Delivery period*
After payment is secured, we aim to deliver your order as soon as possible and as agreed. To provide this service, we depend on other parties such as parcel services and banks. Parcel services deliver only on *"WORK "* days. This means that if you order on Friday after 18:00 or at the weekend, the order will be shipped the next working day (Monday).
Your orders will be processed the same day provided:
- - The order was placed before 18:00
- - The payment has been approved (i.e. in case of transfer, the payment must have been made first)
*ART. 5 Payment*
Orders via the internet site can be paid in the following ways:
- - iDeal
- - Paypal
- - Cash on delivery
*ART. 6 Force majeure*
If SGM Consultancy is prevented from fulfilling the contract in whole or in part due to force majeure and/or is prevented from fulfilling the contract in time, SGM Consultancy will not be liable for any damages. Force majeure is understood to mean any shortcoming that cannot be attributed to SGM Consultancy because it is not due to its fault and is not for its account by virtue of the law, legal acts or generally accepted standards.
*ART. 7 Retention of title*
Ownership of delivered products will not be transferred until Buyer has paid all that it owes to SGM Consultancy under any contract. The risk regarding the products is transferred to the client at the moment of delivery. The moment of legal delivery is the moment the goods are received by the client. Buyer is obliged to cooperate, at its own expense, in the repossession of purchased and delivered products, if it will be in default towards SGM Consultancy in any way.
*ART. 8 Claims and liability*
Buyer is obliged to examine the products immediately upon delivery to determine whether they comply with the contract. Complaints should be submitted to SGM Consultancy in writing within 14 (fourteen) working days after the time of delivery of the products, under penalty of forfeiture of all rights, specifying the nature of the complaints with respect to the products delivered.
*ART. 9 Returns*
Once you have received the product you ordered, you have the option to dissolve the purchase contract with SGM Consultancy, giving reasons, within 14 working days of receipt. The product must be unused and/or unbroken. However, you must bear the cost and risk of the return yourself. SGM Consultancy will not accept returns that are not sufficiently stamped. We are not responsible for incorrectly entered NAW-data (Name, address, place of residence), as a result of which orders cannot be delivered to the right place. SGM Consultancy reserves the right to refuse returned products to credit only part of the amount already paid if the product is damaged due to your actions.
If a product is returned that, in SGM Consultancy's opinion, has suffered damage that is due to an act or omission on your part or is otherwise at your risk, SGM Consultancy will notify you in writing (via letter or e-mail).
*ART. 10 Web statistics*
To analyse visitor behaviour, SGM Consultancy uses Google Analytics. This does not store any privacy-sensitive data. SGM Consultancy only uses these statistics to keep track of visitor numbers, deploy appropriate marketing and make the website more user-friendly.
*ART. 11 Privacy*
The data provided by buyer will be included in the SGM Consultancy customer file. This file also contains the data necessary for order processing, such as order, delivery and payment details. The customer file is used for the execution and settlement of orders and for marketing purposes.
*ART. 12 Intellectual and industrial property rights*
The Buyer must fully and unconditionally respect all intellectual and industrial property rights vested in the products delivered by SGM Consultancy. When purchasing products subject to intellectual and industrial property rights, SGM Consultancy is exclusively entitled to prohibit or allow others to use them. When purchasing products subject to intellectual and industrial property rights, the general terms and conditions of the relevant product (The Health Concept) in force.
*ART. 13 Miscellaneous*
All rights, obligations, offers, orders and agreements to which these terms of delivery apply, as well as these terms of delivery, are exclusively governed by Dutch law
Disputes between the parties will be submitted to the competent court in the Netherlands.
